Impeached Deputy President of Kenya, Rigathi Gachagua is seeking an appeal on the ground that the three judges that presided over the proceedings were faulty.

Gachagua’s counsels, led by John Njomo, insisted that Deputy Chief Justice Philomena Mwilu overstepped her boundaries by appointing the three judges without approval from the Chief Justice.

Earlier to the appeal filed by the Vice President, a three-judge panel upheld the legitimacy of Mwilu’s actions as the Chief Justice stated that the Deputy Chief can act on a temporary administrative duty when considered necessary.

Still not satisfied by the panel’s statement, Gachagua urged the Court of Appeal to issue an injunction stopping the High Court proceedings until his appeal is reviewed.
