Court Adjourns Atiku, ADC Suit Against Tinubu, APC, and INEC to October 13

The Federal High Court in Abuja on Monday, September 28, 2026, adjourned until October 13, 2026, for the hearing of a motion seeking to amend the originating summons in a lawsuit filed by former Vice President Atiku Abubakar and the African Democratic Congress (ADC) against President Bola Tinubu, the All Progressives Congress (APC), and the Independent National Electoral Commission (INEC).

​When the suit, marked FHC/ABJ/CS/1888/2026, came up for further mention before Justice Inyang Ekwo, lead counsel for the plaintiffs, Joseph Silas, informed the court that all court processes had been successfully served on the defendants within the prescribed legal timeline, and that responses had been duly filed.

​The legal proceedings had previously been stalled due to administrative disputes regarding the formal service of court documents on the first defendant, President Tinubu.

​Addressing the court, counsel for the President, Chief Wole Olanipekun, SAN, recalled that during a previous hearing on September 1, 2026, counsel for the APC, Popoola Owosanya, offered to accept the court processes on behalf of the President to resolve service delays.

​Following confirmation from all defense legal teams that they had received the application to amend the originating summons, Justice Ekwo adjourned the matter to October 13 for formal hearing of the motion.
